These General Terms and Conditions of Sale (hereinafter the “GTCS”) govern the sales made on the Ventanou.com website, operated by the company World Service Company, a simplified joint-stock company (SAS) registered in French Polynesia under number F22497, whose registered office is located at BP 80 110 – French Polynesia.
Any order placed on the website implies the buyer’s full and complete acceptance of these GTCS.
1. Scope of application
These GTCS apply to all sales of physical products concluded via the Ventanou.com website, to the exclusion of any other condition.
2. Products
Ventanou offers for sale works and objects of Polynesian art, decorative pieces, furniture, jewelry, textiles, clothing and cosmetic products.
The essential characteristics of the products are described with the greatest care. Photographs and visuals are provided for illustrative purposes only and shall not engage Ventanou’s liability.
3. Orders
Any order validated on the website constitutes a binding sale, subject to effective payment of the price and these GTCS. Ventanou reserves the right to refuse or cancel any order in the event of a prior dispute with the buyer, incorrect information provided at the time of ordering, or suspicion of fraud.
4. Prices
Product prices are indicated inclusive of all taxes (TTC), excluding shipping costs.
Shipping costs, any optional insurance, and ancillary fees are charged in addition and are indicated before final validation of the order.
5. Payment terms
Payment is due in full at the time of ordering.
The accepted payment methods are:
- payment by credit card (excluding American Express),
- payment by bank transfer.
American Express (AMEX) cards are not accepted.
In the event of payment by bank transfer, the order is processed only after effective receipt of the funds in the World Service Company account.
World Service Company shall not be held liable for delays attributable to banking institutions, whether for card payments or bank transfers.
6. Delivery and shipping
Products are shipped from French Polynesia or, for certain specific items, directly from a logistics partner located outside French Polynesia. Delivery times are provided for information purposes only. They may vary depending on logistical, customs, banking constraints or carrier-related constraints. World Service Company shall not be held liable for delivery delays attributable to carriers or circumstances beyond its control. No free shipping is offered. Shipping costs are entirely borne by the buyer.
7. Customs fees and taxes
Any order shipped outside French Polynesia may be subject to customs duties, local taxes or customs clearance fees. These fees, imposed by the authorities of the destination country, are entirely borne by the buyer and may under no circumstances justify a cancellation or a refund of the order.
8. Insurance and transport
Products are checked and carefully packaged before shipping. Depending on the shipping method chosen, the shipment may be sent with or without transport insurance. When offered, insurance constitutes a service separate from the product price and shipping costs.
The choice of shipping method and insurance is exclusively the responsibility of the buyer.
9. No right of withdrawal
In accordance with the law applicable in French Polynesia, no right of withdrawal is offered for sales made on the Ventanou.com website, except where mandatory legal provisions provide otherwise.
10. Claims and returns
Any claim relating to an order must be made in writing within forty-eight (48) hours from receipt of the parcel and must be accompanied by supporting evidence.
In the event of a product declared non-compliant or damaged, no refund may be made until the product has been returned to Ventanou and received by its services.
Return shipping costs are entirely borne by the buyer.
11. Payment disputes and chargebacks
Any chargeback request initiated with a banking institution does not in any way presume Ventanou’s liability. World Service Company reserves the right to provide any useful supporting evidence in the context of these procedures.
12. Liability
World Service Company shall not be held liable in the event of non-performance or improper performance of the contract attributable to the buyer, a third party, or an event of force majeure.
13. Personal data
The processing of personal data is carried out in accordance with the Privacy Policy available on the website.
14. Applicable law and dispute resolution
These GTCS are governed by the law applicable in French Polynesia.
In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the dispute may be brought before the competent courts of French Polynesia, in accordance with the applicable rules.
